Terms of Service
These Terms of Service (the Terms) are a binding agreement between Tri Tech Technology, a software company operating as a registered partnership in Pakistan with its principal place of business at 30 Civic Center, Block D2, Lahore, Punjab, Pakistan 54000 (also referred to as TTT, provider, we, us, or our), and the business or individual registering for the Services (also referred to as the Subscriber, Merchant, client, or you). By creating an account, signing an Order Form, or accessing the Services, you agree to these Terms in full. If you are registering on behalf of a business, you confirm that you have authority to bind that entity. These Terms incorporate our Privacy Policy and Cookie Policy, and, where signed, the Merchant Subscription Agreement and Order Form, which together form the complete agreement between the parties.
1. Definitions
Billing Period means the recurring cycle (monthly unless otherwise stated in your Order) for which Subscription Fees are charged in advance.
Branch means a distinct business location or outlet operated by the Subscriber and configured within the Services.
Customer Equipment means the tablets, computers, printers, cash drawers, card payment terminals, network, and other hardware that the Subscriber uses to access and operate the Services.
Dashboard means the web-based back-office interface through which Subscribers manage their account, branches, menus, inventory, staff, reporting, billing, and settings.
End Customer means a customer of the Subscriber who transacts with the Subscriber through the Services.
Order or Order Form means a subscription or registration confirmation specifying the Subscriber's selected Plan, branches, and applicable fees.
Plan means the subscription tier selected by the Subscriber, which determines the features, limits, and fees that apply.
Services or Platform means the TTT POS point-of-sale software, including the Dashboard, mobile and web applications, terminals, APIs, integrations, and documentation operated by TTT.
Subscriber Content means all data, brand assets, menu and product configurations, prices, inventory and supplier records, sales and transaction records, End Customer records, staff records, and other content uploaded or generated through the Services by the Subscriber.
Subscription Fees means the recurring charges payable in advance for access to the Services during each Billing Period.
Subscription Term means the duration of the Subscriber's active Subscription, from account activation until termination.
Trial means any free or reduced-fee period during which the Subscriber may access the Services before a paid Subscription begins.
Users means the Subscriber and any individuals (owners, managers, cashiers, waiters, and other staff) authorised by the Subscriber to access the Services under its account.
2. The Services
Tri Tech Technology provides a subscription-based, cloud, multi-tenant point-of-sale software platform for hospitality and retail businesses. Depending on the Plan you select, the Services may include order and payment workflows, menu and item management, branch-specific pricing, role-based access control (RBAC) with encrypted user PINs, audit logs, till session and cash-drawer management, inventory and recipe management, supplier and purchase-order management, discounts, rewards, gift cards, void and refund controls, waste tracking, sales, order, and profit-and-loss reporting, CSV import/export, offline operation, and fiscal invoicing integration. The Platform integrates with TTT Loyalty, our proprietary wallet-based loyalty product, enabling real-time points earning, reward redemption, and Customer data synchronisation at the point of sale. TTT may add, modify, or discontinue features at any time and will provide reasonable advance notice where a change materially reduces core functionality.
3. Eligibility and Account Registration
You must be at least 18 years of age to use the Services. You must provide accurate, complete, and up-to-date information when registering — including, where required for fiscal invoicing, your tax registration details (such as NTN/STRN) — and keep that information current. You are responsible for maintaining the security of your account credentials and user PINs, for configuring appropriate role-based access for your staff, and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorised access. Providing false or fraudulent registration information is a material breach of these Terms and grounds for immediate termination.
4. Plans, Fees, and Billing
Subscriptions are billed in advance for each Billing Period (monthly unless your Order states otherwise) and renew automatically at the then-current Plan price. Fees may be charged per Branch or per Plan tier as set out in your Order. Subscription Fees are payable by cheque, bank transfer, or by Stripe, Inc. on our behalf; where you authorise card-based subscription billing, you authorise TTT and Stripe to charge your payment method on file for each renewal.
You may cancel auto-renewal at any time through the Dashboard or by emailing info@tritechtechnologyllc.com. Cancellation takes effect at the end of the current Billing Period; you retain access until then. Fees already paid are non-refundable except where you cancel because of an uncured material breach by TTT, in which case we will refund the unused pro-rata portion of the current Billing Period. Plan or Branch upgrades take effect immediately with a pro-rata charge; downgrades take effect from the next renewal. If a payment fails, we may retry for up to 14 days, during which access to some features may be restricted; if payment remains outstanding after 14 days, we may suspend or terminate the account. TTT may adjust Subscription Fees with at least 30 days' written notice, and you may cancel before the new pricing takes effect.
5. Payment Processing and Your Customers' Transactions
TTT POS is point-of-sale software. It records sales, calculates totals and taxes, and logs the payment method used. It is not a payment processor and does not process, transmit, or store your customers' card data.
When your End Customers pay by card, the payment is processed through your own external card payment terminal and your acquiring bank or payment service provider, under a separate agreement between you and that provider. You are solely responsible for: selecting and contracting with your own card terminal provider and acquirer; complying with all card-scheme rules and any applicable PCI DSS obligations that apply to your acceptance of card payments; the accuracy of amounts entered into the Services; and the handling of cash, refunds, and any chargebacks, disputes, or reversals, which are matters between you, your End Customer, and your acquirer. TTT has no liability for the availability, performance, fees, settlement, or security of any third-party payment terminal, acquirer, or banking service, and is not a party to any chargeback or payment dispute.
6. No Payment or Financial Services
TTT POS is point-of-sale software. TTT is not a Payment System Operator, Payment System Provider, payment service provider, money-services business, or financial institution under the Payment Systems and Electronic Fund Transfers Act 2007 or any State Bank of Pakistan regulation, does not operate a payment system, and does not receive, hold, route, or settle funds. Your acceptance of card and electronic payments is governed solely by your own agreement with your acquiring bank or payment service provider.
7. Customer Equipment, Connectivity, and Offline Operation
The Services are provided as software only. TTT does not supply hardware. You are responsible for providing and maintaining your own Customer Equipment — including compatible tablets or computers, receipt/kitchen printers, cash drawers, card payment terminals, and a reliable internet connection and power supply — and for ensuring it meets any minimum specifications we publish. TTT gives no warranty in respect of any Customer Equipment, whether or not sourced on our recommendation.
TTT POS is designed to continue processing orders and payments during internet outages. During an outage, data is stored locally on your device and synchronised to our servers once connectivity is restored. You are responsible for allowing data to synchronise and for reconciling your records after any offline period. TTT is not liable for any loss of unsynchronised data caused by device failure, clearing of local storage, or uninstallation before synchronisation completes.
8. Taxes and Fiscal Invoicing Integration
Where supported for your province and business type, TTT POS provides integration with the applicable revenue authority's electronic invoicing and sales-reporting system — for restaurant and other taxable services in Punjab, the Punjab Revenue Authority (PRA) under the Punjab Sales Tax on Services Act 2012 and its electronic invoice-monitoring system; for services in Sindh, the Sindh Revenue Board (SRB); and, for taxable goods and Tier-1 retail, the Federal Board of Revenue (FBR) via PRAL — including the issuance of system invoice numbers and QR-coded invoices as required by the relevant authority (including FBR SRO 288(I)/2026, as amended). Availability of any specific integration depends on your location, sector, and registration status, and on the authority's systems, which are outside TTT's control.
This integration is a compliance tool and does not transfer your tax obligations to TTT. You remain solely responsible for: (a) your own tax registration with the relevant authority (including a valid NTN/STRN and any restaurant or services registration); (b) selecting and applying the correct tax rates and categories, including any reduced rate for card or digital payments where applicable; (c) the accuracy and completeness of the sales and tax data you record; and (d) filing and paying all taxes due, and for any penalties, default surcharge, or action arising from your non-compliance. TTT does not warrant uninterrupted availability or acceptance of transmissions by any authority, gives no tax, accounting, or legal advice, and is not liable for authority downtime, rejected submissions, or changes in fiscal rules. Subscription Fees are exclusive of taxes, which you shall pay where applicable.
9. Authorised Users, Delegated Access, and Internal Controls
You are responsible for all access to and use of the Services under your account, and for all acts and omissions of your Users — including owners, administrators, managers, cashiers, waiters, and any person to whom you grant a login, PIN, or role — as if they were your own. You are responsible for configuring role-based access, manager overrides, and branch restrictions appropriately, for keeping all credentials and PINs confidential, and for promptly disabling access for departing staff. The Services provide audit-trail, role-based-access, and reporting features as tools to assist your internal controls; TTT does not monitor your staff and is not responsible or liable for your internal cash handling, shrinkage, theft, fraud, unauthorised discounts, voids, or refunds, or any misuse of the Services by your Users. You shall indemnify TTT against any claim by a User or third party arising from your management of your Users or your internal controls.
10. Usage Limits, Fair Use, and API Access
You must operate within the usage limits of your Plan, including limits on Branches, Users, transactions, and API requests. Where your Plan includes API access, you must use it in accordance with our documentation, keep API keys secure, and not use it to circumvent Plan restrictions or overload shared infrastructure. TTT may throttle, restrict, or require a Plan upgrade where usage materially and consistently exceeds Plan limits or adversely affects other Subscribers.
11. Beta and Early-Access Features
TTT may make certain features available on a beta or early-access basis. These features are provided on an as-is basis without warranty, may be modified or withdrawn at any time without notice, and are not covered by any uptime commitment or service level. By using beta features, you accept all risk associated with their experimental nature.
12. Subscriber Content and Data
You retain full ownership of all Subscriber Content. You grant TTT a limited licence to host, store, process, and display your content solely to the extent necessary to provide the Services. You are responsible for ensuring you have all necessary rights to upload your content and that it does not infringe any third-party rights.
Personal data relating to your End Customers and your staff remains your data. You act as the data controller for that data, and TTT acts as a data processor processing it on your instructions and as set out in our Privacy Policy and the Data Processing Addendum to the Merchant Subscription Agreement. You are responsible for ensuring a valid lawful basis exists for its collection and processing and for handling those individuals' data-rights requests.
Aggregated and anonymised data. In addition to hosting and processing Subscriber Content to provide the Services, you grant TTT a perpetual, irrevocable, royalty-free licence to generate and use aggregated and de-identified data derived from use of the Services — that is, data that does not identify, and cannot reasonably be used to identify, you, any End Customer, or any individual — to operate, secure, analyse, benchmark, and improve the Services and to produce industry insights. TTT will not disclose Subscriber Content in identifiable form to any third party, and will not use Subscriber Content to train or develop any AI or machine-learning model. Aggregated and anonymised data is not Subscriber Content and is owned by TTT.
13. Intellectual Property
The Services, including the Platform software, design, documentation, and brand elements, are owned by TTT or its licensors. Subject to your compliance with these Terms and payment of fees, TTT grants you a non-exclusive, non-transferable right to access and use the Services during the Subscription Term for your internal business operations. You may not copy, modify, reverse engineer, resell, sublicense, or use the Services to build a competing product. TTT reserves the right to pursue all available legal remedies for infringement of its intellectual property rights.
14. Feedback
If you share feedback, suggestions, or feature ideas with us, TTT may use them freely without restriction or compensation. Feedback is not treated as confidential unless agreed in writing.
15. Acceptable Use Policy
You must not use the Services in any way that violates applicable law, infringes third-party rights, or causes harm to TTT, other Subscribers, or their End Customers. Prohibited conduct includes recording false or fraudulent transactions or tax data, using the Services to evade lawful tax obligations, uploading malicious code, scraping the Platform beyond what your Plan permits, attempting to gain unauthorised access, and any activity that creates material legal or reputational risk for TTT.
16. Trust and Safety
TTT operates trust-and-safety controls to protect the integrity of the Platform and its users. We may require identity or business verification as a condition of account activation or access to certain features, and may apply account restrictions where a review identifies a risk. Where we impose a material restriction, we will inform you of the reason and any available steps to resolve it, to the extent we are able to do so.
17. Third-Party Services and Integrations
The Platform integrates with third-party services including Stripe for subscription payment processing, Intercom for in-app support, and Google for reCAPTCHA and optional Single Sign-On. Your use of these services is subject to each provider's own terms and policies. TTT is not responsible for the availability or performance of any third-party service, including any external card payment terminal, acquirer, printer, or banking service, and does not warrant that any integration will remain available or unchanged.
The Platform also integrates with TTT Loyalty, TTT's own loyalty product. Where a Subscriber uses TTT Loyalty alongside the Services, transaction data, End Customer records, and loyalty activity are synchronised between the two systems. Use of TTT Loyalty is subject to its own separate terms of service.
18. Platform Availability, Service Levels, and Support
TTT will use commercially reasonable efforts to keep the Services available, subject to scheduled maintenance, emergency fixes, and events outside our control. TTT targets 99.5% monthly availability of the core point-of-sale and checkout functions, measured monthly and excluding scheduled maintenance notified in advance, emergency maintenance, force-majeure events, your own equipment, network, or power, and third-party services. TTT will use reasonable efforts to schedule maintenance outside peak food-and-beverage trading hours (between 02:00 and 06:00 PKT). The offline capability described in clause 7 is the first-line mitigation for connectivity interruptions. If verified availability falls below the target in a calendar month, your sole and exclusive remedy is a service credit of 5% of that month's Subscription Fee, requested within 30 days. This is a target, not a guarantee, and no service level applies to Trial or beta features. Support is available through the in-app Intercom chat and by email to info@tritechtechnologyllc.com. We aim to acknowledge support requests within 2 business days; resolution timelines vary by issue.
19. Data Protection
Where TTT processes personal data on your behalf in connection with the Services, it does so as a data processor acting under your instructions, as further described in our Privacy Policy and the Data Processing Addendum to the Merchant Subscription Agreement, each of which forms part of these Terms. You, as data controller, are responsible for ensuring a valid lawful basis exists for all personal data processing carried out through the Services.
20. Confidentiality
Each party may receive non-public, proprietary information from the other. Each party agrees to hold the other's confidential information in strict confidence, use it only as needed to perform its obligations under these Terms, and not disclose it without prior written consent. These obligations survive termination for three years. Confidentiality does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
21. Publicity
TTT may refer to you as a customer and use your business name and logo in marketing materials and case studies. You may withdraw this permission at any time by writing to info@tritechtechnologyllc.com, and we will cease use of your branding in new materials within a reasonable period.
22. Ethical and Regulatory Compliance
Both parties agree to comply with all applicable anti-bribery, anti-corruption, and anti-money-laundering laws in their respective jurisdictions, including applicable Pakistani legislation. You represent that you and your Users are not subject to any applicable sanctions regime or trade embargo restrictions.
23. Term, Suspension, and Termination
These Terms take effect when you first accept them and remain in force for the duration of the Subscription Term. Either party may terminate for cause with 30 days' written notice if the other commits a material breach that remains uncured, becomes insolvent, or ceases to carry on business. TTT may suspend your access immediately where fees are unpaid beyond 14 days, where you are in material breach of the Acceptable Use Policy, where required by law, or where necessary to protect the security and integrity of the Platform. On termination, your access ends, you may request a data export within 30 days (subject to outstanding fees being paid), and all accrued payment obligations remain due. You remain responsible for retaining your own tax-invoice records as required by law.
24. Disclaimer of Warranties
The Services are provided on an as-is and as-available basis without any warranty of any kind. TTT does not warrant that the Services will be uninterrupted, error-free, or free from security vulnerabilities, or that they will meet any particular tax, accounting, or regulatory requirement. You are responsible for determining whether the Services are suitable for your business needs before subscribing.
25. Limitation of Liability
Neither party is liable to the other for indirect, incidental, consequential, or punitive damages. To the maximum extent permitted by law, TTT shall have no liability for loss of profits, loss of revenue or anticipated savings, loss of sales or business, loss of goodwill, or business interruption, whether direct or indirect, however arising. Each party's total liability in any 12-month period is capped at the greater of PKR 150,000 or the total Subscription Fees paid by the Subscriber in the three (3) months immediately preceding the event giving rise to the claim. These limits do not apply to fraud, death or personal injury caused by negligence, the Subscriber's obligation to pay fees, or either party's indemnification obligations. Where a service level applies, service credits are the Subscriber's sole and exclusive remedy for any failure to meet availability targets. TTT has no liability for losses arising from third-party payment terminals, acquirers, banking services, or Customer Equipment, or from the Subscriber's own tax compliance.
26. Indemnification
You agree to indemnify and hold TTT harmless from any third-party claims arising from your Subscriber Content, your breach of the Acceptable Use Policy, your failure to obtain valid consents for End Customer or staff data processing, your management of your Users or internal controls, your tax compliance or card-payment acceptance, or your violation of applicable law. TTT will indemnify you from third-party claims that your authorised use of the Services infringes a registered intellectual property right, except where the claim arises from your content or unauthorised modifications. The party seeking indemnification must promptly notify the other and cooperate reasonably in the defence of the claim.
27. Force Majeure
Neither party is in breach of these Terms for any failure or delay caused by circumstances beyond its reasonable control, including natural disasters, war, government action, power or internet outages, or failures of third-party infrastructure providers. This does not apply to the Subscriber's obligation to pay fees. The affected party must notify the other promptly and use reasonable efforts to resume performance.
28. Changes to These Terms
TTT may update these Terms from time to time. For material changes, meaning those that substantively affect your rights or obligations, we will give at least 30 days' written notice by email and in-app announcement. Non-material changes take effect on publication. If you do not accept a material change, you may cancel before it takes effect. Continued use of the Services after the effective date of any change constitutes acceptance of the updated Terms.
29. Governing Law and Jurisdiction
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan, except that either party may seek urgent injunctive relief in any court of competent jurisdiction.
30. Dispute Resolution
Before starting formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. The party raising the dispute must send written notice describing the issue and the outcome sought, and both parties will engage in negotiations within 30 days of that notice. If no resolution is reached, either party may pursue its remedies before the courts of Lahore as set out in clause 29. Nothing in this clause prevents either party from seeking urgent injunctive relief at any time.
31. Assignment
You may not assign or transfer these Terms without TTT's prior written consent. TTT may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of its business, with written notice to you.
32. Notices
Formal notices to TTT must be sent by email to legal@tritechtechnologyllc.com. Notices to you will be sent to your registered account email address or delivered by in-app announcement. Email notices are deemed received on the next business day after sending.
33. Entire Agreement, Severability, and Waiver
These Terms, together with our Privacy Policy, Cookie Policy, and any signed Merchant Subscription Agreement or Order Form, form the entire agreement between the parties and supersede all prior agreements on the same subject. Where there is a conflict, a signed Merchant Subscription Agreement or Order Form prevails over these Terms. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in full force. A failure to enforce any right does not waive it on any future occasion. These Terms do not confer any rights on third parties.
